BLUE SQUARE GAMING (ALDERNEY) LTD TERMS AND CONDITIONS OF USE OF THE "BETTING SERVICES"
The terms and conditions set out below comprise the terms and conditions of use for any of the betting services ("Betting Services") provided in whatever form including bluesq.com, bluesqcasino.com and through whatever delivery mechanism offered and by whichever Blue Square company. These terms and conditions and any applicable rules ("Rules") that apply to the Betting Services which can be found on www.bluesq.com ("the Website") together constitute an agreement ("Agreement") between Blue Square Gaming (Alderney) Limited or Rank Interactive Gaming (Alderney) Limited (referred to as "us", "we" or "our") as appropriate and you. We will also send you a paper copy of the Rules on request.
1. AGREEMENT
By using the Betting Services, you agree to accept the terms of this Agreement and establish an account with us and make payments to us in accordance with such terms.
2. AMENDMENTS TO THIS AGREEMENT AND TERMINATION
We may: (1) revise the terms and conditions of this Agreement (including the Rules); and (2) change the Betting Services at any time. Any such revision or change will be effective immediately on its posting on the Website, or on notification to you by email or by post and you agree to check for revisions and changes on each occasion you use the Betting Services. Use by you of the Betting Services at any time following such posting or notification shall constitute your acceptance of such revisions or changes.
3. CHANGES TO YOUR ACCOUNT
To change any of your account information or access the Betting Services, you must use your security access details (i.e., username, account number, password and/or PIN) that you selected when you opened your account with us and/or any supplemental or amended security access details. You will safeguard such security access details from any unauthorised use. We will not be liable to you for any loss you suffer as a result of any unauthorised use or misuse of your security access details other than through our negligence.
4. INTELLECTUAL PROPERTY
All copyright, trademarks designs, text and graphics, and their layout and arrangement and all other intellectual property rights relating to the material or content of the Betting Services and the Website or other delivery mechanism are and shall remain our (or our licensor's) property. The Betting Services and their material and content are made available for your personal non-commercial use. Any other use of such items or rights without our prior written consent is not permitted.
5. BETTING AND PAYMENT
You will deposit monies by way of debit card or credit card (subject to our acceptance of the relevant card), Moneybookers, Neteller or Ukash vouchers, to an account with us in accordance with our procedures, against which you shall be able to use the Betting Services.
Interest is not payable on account balances.
We reserve the right to make a charge directly on your account in respect of deposits or withdrawals which we believe have been made for purposes primarily associated with reasons other than wagering on the Website. A charge may also be made by us on your account for manipulation of your account by the making of multiple deposits and withdrawals without significant play.
We do not accept any liability for errors in the Website systems or software or any other element of the Betting Services including generation of random numbers, payout tables and bet settlement and we reserve the right to void all bets on any transactions affected by any such error. You undertake to promptly notify us of any error of which you become aware and not to take advantage of it. We reserve the right to recover from you any monies that you may receive as a result of gaining from any such error together with all costs and expenses incurred in making such recovery.
If we suspect you have made significant deposit(s) and withdrawal(s) to and from your account with us, to obtain goods or services from a third party, such as Air Miles, whilst only placing minimal wagers in relation to the size of the deposit, we reserve the right to charge a 5% handling fee, to be deducted from the withdrawal, to cover all bank charges etc associated with said deposit(s). We also reserve the right to withhold payment for up to 28 days in accordance with section 10 of our Terms and Conditions (Right of Refusal).
6. USE OF THE BETTING SERVICES BY YOU AND BY THIRD PARTIES/AGENTS
You shall fulfil all commitments made on your account in the course of using the Betting Services and be responsible for all communication you have with the Betting Services. You agree that if any other person uses the Betting Services through your account, you shall (subject to us taking reasonable precautions against fraud and computer hacking) be bound by such use as if it were your use, and you shall fully indemnify us in respect of any failure by such third party to fulfil any commitments made by such use.
We shall only honour bets which we have actually received and bets shall only be treated as received at the time that our systems actually receive them.
7. LIMITATION OF LIABILITY
Our total aggregate liability to you under this Agreement for any claim in contract, tort, negligence or howsoever otherwise arising out of or in connection with the Betting Services, and your exclusive remedy with respect to any Betting Services provided under this Agreement and any breach of this Agreement is limited to damages equal to the greater of the amount that you paid in respect of such Betting Services and any winnings to which you may be entitled under this Agreement. We shall in no event be liable to you for any loss of profits or for any other indirect, consequential or economic loss whatsoever. We shall not be liable for any loss or liability resulting from, but not limited to: (1) access delays or access interruptions; (2) data non-delivery or data mis-delivery; (3) acts of god or other circumstance(s) beyond our control; (4) the unauthorized use of your security access details; and (5) errors, omissions, or misstatements in any and all information or services(s) provided under this Agreement. However nothing in this Agreement shall exclude our liability for death or personal injury arising from our negligence.
8. INDEMNITY
You shall indemnify, and hold us harmless on demand (and keep us so indemnified or held harmless) against any claim brought against us by a third party resulting from or in connection with your use of the Betting Services or the Website or any other delivery mechanism in any way and your use of our server and in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including legal costs and expenses) or liabilities whatsoever suffered and howsoever incurred by us in consequence of or relating to your non- observance or breach of this Agreement or from the services provided.
9. WARRANTY AND DISCLAIMER
You warrant that the information you provide to us to register (and during your use of the Betting Services) is, to the best of your knowledge and belief, accurate and complete, and that any future changes to this information will be provided to us in a timely manner. You accept that your use of the Betting Services is solely at your own risk and that the information contained in the Betting Services may contain bugs, errors or other limitations.
We do not represent or warrant that the information accessible from the Website or any other delivery mechanism is accurate, complete or current. The Betting Services and the contents of the Website and any other delivery mechanism are provided on an "as is," "as available" basis without warranties, representations or undertakings of any kind and we hereby exclude all conditions, terms, representations (other than fraudulent representations) and warranties relating to the Betting Services supplied under this Agreement whether imposed by statute or operation of law or otherwise that are not expressly stated in this Agreement including, without limitation, the implied warranties of satisfactory quality, merchantability and fitness for a particular purpose.
We shall have no responsibility nor shall be liable for any damages caused by viruses contained within the Website or any other delivery mechanism.
10. RIGHT OF REFUSAL
We in our sole discretion, reserve the right to refuse to register you and/or to suspend and/or terminate your registration and/or account at any time and or to refuse to accept any bet or transaction in respect of or in connection with your use of the Betting Services. We shall not be obliged to provide you with any reasons for so doing and shall not be liable to you in any way for any loss or damages that may result from any such action. Furthermore, we reserve the right to refund to you or withhold any payment of monies from or into your account if there is manipulation of our financial system or suspicion or evidence thereof or a breach or suspected breach of any applicable law, regulation or any of these terms, in each case without providing any reason.
Use of any account otherwise than in accordance with these Terms or any other abuse of any account is strictly prohibited.
We reserve the right to withhold free bets and withdraw promotional offers at any time.
We reserve the right to withdraw your use of any of the Betting Services at any time, subject to fulfilment of any outstanding commitments under the Rules.
11. SEVERABILITY
The terms of this Agreement are severable. If any term or provision is declared invalid or unenforceable, that term or provision will be construed in the light of applicable law as nearly as possible to reflect the original intentions of the parties, and that the remaining terms and provisions of this Agreement will remain in full force and effect.
12. ASSIGNMENT AND ENTIRE AGREEMENT
This Agreement is made exclusively between us and you. You shall not be entitled to assign or transfer this Agreement in any way. You agree that this Agreement is the complete and exclusive agreement between you and us regarding your use of the Betting Services. This Agreement supersedes all prior agreements and understandings between us and you, whether established by custom, practice, policy or precedent.
13. GOVERNING LAW
This Agreement shall be treated as though executed and performed in England and governed in all respects by and construed in accordance with the laws of England and Wales. You and we each submit to exclusive jurisdiction of the courts of England and Wales.
14. PROOF OF AGE
We reserve the right to ask for proof of age and evidence to verify your identity at any time and will be carrying out regular checks of our members. We reserve the right to conduct checks against any of the details provided to us and pursue this information through any channels and methods available to us. Failure to provide substantiated proof of age or other requested information will result in the suspension of your account for up to 3 months, following which any funds will be forfeited by you. Any monies due or requested during this time will be withheld unless the requested information is provided.
15. USE OF INFORMATION
The privacy policy forms part of these terms and conditions.
16. BLUESQ TV
1. Proprietary Rights and Intellectual Property
The Footage is owned by Racing UK Limited ("Racing UK") and licensed to The Betting Site Limited ("TBS"). Racing UK shall remain the exclusive legal and beneficial owner of all copyright and intellectual property rights in the Footage in perpetuity. All rights not explicitly granted herein are reserved by Racing UK and TBS.
2. Permissible Use and Restrictions
2.1 You may view the Footage once on a personal computer screen for personal, private, domestic, non-commercial uses only in accordance with these terms and conditions.
2.2 You shall not:
2.2.1 make the Footage available to anyone else;
2.2.2 use or view the Footage other than as expressly permitted by these terms and conditions, or copy, relay, broadcast, or communicate the Footage to the public, nor may you include any portion of or all of the Footage in any equipment or item save as specifically permitted under these terms and conditions or develop any improvement or derivative works of any part or all of the Footage;
2.2.3 save, edit, copy, amend, distort, modify, distribute, reformat, disassemble delay or repeat the Footage and/or its transmission or do anything that is contrary to any of the moral rights or other rights of the copyright owner of the Footage;
2.2.4 remove any product identification (including but not limited to screen icons), legend or notice, or any proprietary or copyright notice from any part of the Footage;
2.2.5 represent or claim that you own any part or all of the Footage or otherwise do anything that is inconsistent with TBS' and/or Racing UK's rights in the Footage;
2.2.6 store or transmit any Footage to any publication, user group, other website, electronic bulletin board, mailing list, server or other storage device in any form;
2.2.7 sell or commercially exploit any part or all of the Footage in any way.
3. Third Party Rights
Each of or all of Racing UK, TBS and Trinity Mirror PLC and its group companies may enforce any provision of these terms and conditions against you as a third party contract beneficiary whether in the name of Blue Square Gaming (Alderney) Ltd or in its own name. The Contracts (Rights of Third Parties) Act 1999 shall apply to these terms and conditions.
